This agreement
These Terms of Service are an agreement between you and Dunamis AI (“Dunamis AI”, “we”, “us”). They cover the website at dunamisofficial.com, your workspace, and the video editing we do for you (together, the service).
These Terms include our Billing, Cancellation and Refunds page and our Acceptable Use Policy. Our Privacy Policy explains how we handle personal information.
You accept these Terms when you check the box agreeing to them, when you sign up or choose a plan. If you use the service for a business, you accept them for that business too, and you confirm you are allowed to do so; “you” then means both you and the business.
Who can use the service
The service is for businesses and people working on their own business. You must be at least 18 and able to make a binding contract. You must give us accurate account details and keep them up to date. The service is offered in the United States.
Your account
You sign in with your email, using a password or an emailed link. Keep your password and that email account secure, because anyone who can sign in as you can act for your workspace. You are responsible for what happens in your workspace. Tell us right away at support@dunamisofficial.com if you think someone has used it without your permission.
How the service works
- You pick a style, upload your footage and fill in a short brief.
- We edit a draft. You review it and leave notes at the exact moment you want changed. Each plan includes a set number of revision rounds per video, shown on your Billing page; you can buy more.
- When you approve the finished video, you download it.
Sermon clips. When you send a sermon recording, we cut it straight into finished clips for you to download. Sermon clips don’t have a draft review or revision rounds.
How AI is used. AI plans, assembles and checks every edit. No person reviews a draft before you see it; our team steps in when an edit fails. AI can make mistakes, so please review your draft carefully, including captions, names and spelling, before you approve it. Once you approve a finished video, you are responsible for checking it before you post it.
Timing. Any turnaround times we show are estimates, not guarantees. Timing depends on your footage, how quickly you review, and how many changes you ask for.
What we can make. We edit the footage you send. We may decline a brief or a change that the footage can’t support, that would take far more work than a normal video, or that breaks these Terms. If we can’t make a video you sent, it goes back to your allowance (see Refunds).
Changes to the service. We keep improving the service and may change or stop features. If we stop something you’re paying for, we’ll tell you in advance and give you a fair alternative or a prorated refund for the time you can’t use it.
Your content and the license you give us
You keep all ownership of what you send us: footage, music, logos, reference videos, briefs and notes (your content).
You give us a non-exclusive, worldwide, royalty-free license to host, copy, process, analyze, edit, transcribe and adapt your content, and to share it with the service providers listed in our Privacy Policy, only as needed to provide the service to you, keep it safe and follow the law. This license ends when your content is deleted, except for copies we must keep by law. We don’t use your content to train AI models.
Reference videos. If you send videos made by others so we can learn a style, you confirm you are allowed to share them with us for that purpose. We study them only to learn the look, and we don’t put their footage, music or graphics into your video. Don’t ask us to copy someone else’s logo, characters or other distinctive protected material.
Your promises about your content
For everything you send us and every video you ask for, you promise that:
- you own it or have all the rights, licenses and permissions needed for us to use it as these Terms describe, and for you to publish the finished video where you plan to;
- music you supply is licensed for use in your videos on the platforms where you post them. Platforms such as Instagram or TikTok may still mute or claim a video with copyrighted music, and that is outside our control;
- everyone who can be identified in your footage has agreed to appear in a video promoting your business and to the processing described in our Privacy Policy, including finding where faces and speakers are in the frame. For anyone under 18, a parent or legal guardian agreed. You keep records of that permission and will share them if we ask;
- the video, and what it says about your business, products or results, is truthful and lawful, including any testimonials and health, financial or earnings claims;
- your content follows our Acceptable Use Policy.
Who owns the finished video
Once you have paid for it, the finished video is yours. We assign to you any rights we have in the finished video, so you can use it however you like, including commercially and on any platform.
Some things inside it stay ours or our licensors’, and you get a license to them instead:
- sound effects, fonts, music beds, graphics or other assets from libraries we license, which you may use only as part of that finished video, not separately;
- our software, workspace, templates, edit plans, motion and caption designs, and editing methods, which we can keep using for anyone. Your saved styles are used only for your videos.
Keep your own copy of every finished video. We store it while your account is open (see our Privacy Policy), but we aren’t a backup service.
Showing your videos
We never show your videos, footage, name or logo in our marketing, portfolio or website unless you give us written permission for that video (an email is enough). You can withdraw permission at any time by emailing support@dunamisofficial.com; we then take it down from anything we control within 7 days, though we can’t recall copies others already made.
Plans, payment and cancellation
Paid plans are monthly subscriptions that renew automatically until you cancel. By choosing a plan, you authorize us, through our payment processor Stripe, to charge your payment method the plan’s price plus any tax when you subscribe and every month after that, until you cancel. You can cancel online at any time; cancellation takes effect at the end of the month you paid for.
Allowances, plan changes, failed payments, price changes and refunds work as described on our Billing, Cancellation and Refunds page, which is part of these Terms.
Our service and feedback
The service, including the website, workspace, software, designs and the Dunamis AI name and logo, belongs to us and our licensors. These Terms give you the right to use the service for your business while you follow them; they don’t give you any other rights in it.
If you send us suggestions or feedback, we may use them freely without owing you anything. We won’t name you as the source without your permission.
Suspension, closing your account and ending these Terms
You can stop using the service at any time. Cancel your plan as described on the Billing page, or close your account yourself on the Your account page. Closing also ends your plan and deletes your content as our Privacy Policy describes. You can also email support@dunamisofficial.com to ask us to close it.
We may suspend or close your account, or refuse or stop work on a video, if you break these Terms or our Acceptable Use Policy, if you don’t pay, if we must do so by law, or if your use creates a risk for us, our customers or others. Where it’s reasonable, we’ll warn you first and give you a chance to fix the problem. If we close your account without a reason that is your fault, we refund the unused part of any prepaid period.
When your account closes, your right to use the service ends and we delete your content as our Privacy Policy describes. You can download your finished videos and your data before then. Sections that by their nature should last (ownership, your promises, disclaimers, limits of liability, indemnity and disputes) continue after these Terms end.
Disclaimers
We edit with care, but the service and every video are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the service will be uninterrupted or error-free, that AI output will be accurate, or that any video will get a particular number of views, followers, leads or sales. Some states don’t allow these disclaimers, so parts of this section may not apply to you.
Limits on our liability
To the fullest extent the law allows: (a) we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, even if we were told they were possible; and (b) our total liability for all claims about the service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event that gave rise to the claim, or US $100.
These limits don’t apply to liability that the law doesn’t allow us to limit, such as for fraud, or for gross negligence or intentional misconduct where the law doesn’t allow a limit.
Your responsibility for claims about your content
You will defend and indemnify us, and the people who work with us, against claims, damages, losses and costs (including reasonable lawyers’ fees) brought by someone else that arise from your content, your videos as you publish them, a broken promise in the “Your promises about your content” section, or your breach of these Terms or the law. We will tell you promptly about a claim, let you control the defense (we may join with our own lawyer at our cost), and won’t settle a claim that makes you admit fault or pay money without your consent.
Disputes
Talk to us first. Before filing a claim, email support@dunamisofficial.com with a description of the problem and what you want. We’ll try in good faith to resolve it with you within 30 days.
Law and courts. These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law rules. Any dispute that isn’t resolved informally will be heard only in the state or federal courts located in Maricopa County, Arizona, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in small-claims court if it qualifies. Nothing here stops either of us from asking a court for urgent relief to protect intellectual property or confidential information.
If you are a consumer, these Terms don’t take away any rights the law of the place you live gives you that can’t be waived by contract.
Changes to these Terms
We may update these Terms as the service or the law changes. We post the new version here with a new effective date. If a change is material, we email the account owner at least 30 days before it takes effect, except where a change is required sooner by law. If you don’t agree to a change, you can cancel before it takes effect; if you keep using the service after that date, the new Terms apply from then on. Changes never apply to a dispute that arose before they took effect.
General terms
- Whole agreement. These Terms, with the pages they include, are the whole agreement between you and us about the service and replace earlier understandings.
- Notices. We send notices to the email address on your account. Send notices to us at support@dunamisofficial.com.
- Electronic records. You agree that these Terms, notices and receipts may be given and signed electronically.
- Events beyond our control. We aren’t responsible for delays caused by things we can’t reasonably control, such as outages at our providers, power or internet failures, or natural disasters.
- Assignment. You may not transfer these Terms without our written consent. We may transfer them to a company that takes over the service, and we’ll tell you if we do.
- Severability and waiver. If a court finds part of these Terms unenforceable, the rest stays in effect. Not enforcing a term right away doesn’t mean we give it up.
- Relationship. We are independent contractors. These Terms don’t create a partnership, employment or agency relationship, and they give no rights to anyone else.
